Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Student," "User," or "you") and eCerts Now ("Company," "we," "our," or "us") governing your access to and use of the exam preparation platform available at prep.ecertsnow.com (the "Service"). By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

2. Eligibility

The Service is intended for active fire service professionals and candidates preparing for promotional examinations. You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration and Security

Access to the Service requires an account. Your login credentials are provided by eCerts Now upon enrollment activation. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect unauthorized access to your account. Sharing your credentials with others is strictly prohibited and may result in immediate suspension of your access without refund.

4. Enrollment and Access

Upon completing enrollment and payment, you will receive access to the exam preparation course associated with your department and exam type. Access is granted for a single user only and expires on your stated exam date. Key terms of your enrollment:

• Access is personal, non-transferable, and limited to one individual account.
• Access automatically expires on the exam date you provided at enrollment.
• eCerts Now reserves the right to suspend or terminate access for violation of these Terms.
• If your exam date changes, contact us to request an extension. Extensions are granted at our discretion.

5. Payment and Fees

The current enrollment fee is $497 (USD), payable as a one-time payment processed through our payment partner. All fees are in U.S. dollars. By completing payment, you authorize the charge to your selected payment method.

eCerts Now reserves the right to change pricing at any time. Price changes will not affect enrollments that have already been paid and activated.

6. Refund Policy

Due to the digital and immediately accessible nature of the Service, all sales are final. We do not offer refunds once your account has been activated and login credentials have been delivered.

Exceptions may be considered on a case-by-case basis in extraordinary circumstances (e.g., exam cancellation by the department). To request a refund consideration, contact us at [email protected] within 7 days of enrollment activation. We reserve the right to approve or deny any refund request at our sole discretion.

7. Intellectual Property

All content on the Service — including but not limited to question banks, study materials, course content, software, text, graphics, logos, and design — is the exclusive property of eCerts Now and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the content solely for your personal exam preparation. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from the Service without our prior written consent.

8. User-Submitted Content

When you submit study materials (PDFs, documents) for a department course request, you represent and warrant that you have the right to share those materials and that doing so does not violate any third-party rights or applicable law. By submitting materials, you grant eCerts Now a non-exclusive, royalty-free license to use those materials to create exam preparation content for the Service.

9. Prohibited Conduct

You agree not to:

• Share, sell, or transfer your account credentials to any other person
• Copy, scrape, or systematically download content from the Service
• Attempt to reverse-engineer, decompile, or tamper with the platform
• Use the Service for any unlawful purpose or in violation of any applicable regulation
• Impersonate any person or entity or misrepresent your affiliation with a fire department
• Interfere with or disrupt the integrity or performance of the Service

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ECERTS NOW DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY THAT USE OF THE SERVICE WILL RESULT IN PASSING ANY EXAMINATION OR ACHIEVING ANY PARTICULAR SCORE. EXAM OUTCOMES DEPEND ON MANY FACTORS BEYOND OUR CONTROL.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ECERTS NOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR ENROLLMENT.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
